International law firm Freshfields Bruckhaus Deringer has advised German public sector bank BayernLB on a substantial package of financial measures in order to secure its stability. The package is made up of three elements: a capital increase of €10bn through the federal state of Bavaria; a guarantee of assets through the German government's stabilisation fund Sonderfonds Finanzmarktstabilisierung (SoFFin) in the amount of more than €15bn; and a €6bn provision for financial risks deriving from non-performing asset backed securities. Freshfields advised BayernLB with respect to all three parts of the stability package and throughout negotiations with SoFFin, the European Commission and the bank's shareholders. The Freshfields team was led by partners Benedikt Wolfers (Public Law/Regulatory) and Matthias-Gabriel Kremer (Corporate), and included fellow partners Andreas von Bonin (Antitrust, Competition and Trade), Norbert Schneider (Tax), Andreas Bartsch and Christoph Gleske (both Finance).
