International law firm Norton Rose LLP has advised the German Federal Ministry of Transport, Construction and Urban Development (Bundesministerium für Verkehr, Bau und Stadtentwicklung, BMVBS) and the regional council (Regierungspräsidium) of the city of Karlsruhe regarding the procurement of the PPP project motorway A5 from Malsch to Offenburg in the southern German state of Baden-Württemberg. On 10 February 2009 the relevant authority of the state of Baden-Württemberg awarded the project to the syndicate Hochtief-VINCI-Reif-Kirchhoff. The project consists of the extension of a 41.5 km long section of motorway A5 between Malsch and Offenburg from four to six lanes as well as the financing of this extension, and the operation and maintenance of this part for a period of 30 years. The remuneration for the concessionaire is calculated on the basis of the heavy vehicle toll received for the relevant part of the motorway under the federal tolling system. Financial Close was reached on 30 March 2009. Norton Rose is a leading member of the team of advisors which developed the tender process and advised the public sector through the tender and negotiation procedure up to the award and financial close. The team has successfully defended the public authorities in two public procurement proceedings within this project. The A-model project A5 in Baden-Württemberg is the fourth and final PPP pilot project for German motorways. Norton Rose LLP has already been involved as legal advisor in the first two pilot projects for German motorways which were closed in 2007, and in the so far largest PPP-motorway project, the extension of motorway A1 between Hamburg and Bremen, which closed in June 2008. The same team of advisors has now acted on the A5 project. The Norton Rose LLP team was lead by Munich partner Dirk Trautmann together with Brussels partner Michael Jürgen Werner, assisted by Christian Bauer (Munich) and Caspar Ebrecht (Brussels).
