Double success for "Zeitungszeugen": Nörr vindicates publication of historical weekly

The nationwide seizure of supplements from the second edition of the weekly newspaper "Zeitungszeugen" was illegal and has been set aside. A Nörr team led by the Berlin copyright lawyer Dr. Ulrich Michel and the Munich criminal lawyer Dr. Christian Pelz obtained this judgement of the second criminal division of the Landgericht Munich I for the English publisher Peter McGee (21 April 2009, File No. 2 Qs 11/09). The judgement has come into legal effect.
Zeitungszeugen is established by leading historians and press researchers and deals with German history between 1933 and 1945. With each edition copies of two or three contemporary newspaper extracts of different political orientation are provided. This includes newspapers close to the NSDAP. By providing these supplements, the publisher intends to present an authentic picture of the period concerned. Today's reader is intended to be able to experience the events just like a contemporary reader.
The State of Bavaria attempted to stop the supplement with the NSDAP newspapers "Völkischer Beobachter" and "Der Angriff" both by means of civil law and criminal law proceedings. It invoked the exercise of copyright of Adolf Hitler and Joseph Goebbels. The seizure which was accompanied by considerable publicity was found by the second criminal division to be illegal because Zeitungszeugen serves social investigation and reporting of historical events. In a proceeding conducted by Michel before the 21st civil chamber of the Landgericht Munich I, it was ultimately decided that the injunction application of the State of Bavaria was unfounded at least for newspapers up to 1939. This judgement has not yet come into legal effect.
