Freshfields expands US litigation practice with new partner

International law firm Freshfields Bruckhaus Deringer LLP today announced that David J. Onorato, former Deputy General Counsel and Director of Litigation at Bank of America, has become a partner in the firm’s United States litigation practice group, based in New York.
David joins a team of respected US litigators, including Aaron Marcu, Benito Romano and Adam Siegel, who make up the US-based component of the firm’s leading global white-collar and investigations practice group, and Lucy Reed, Nigel Blackaby, Brian King and Alex Yanos, partners in Freshfields’ international arbitration group, which recently won the Chambers USA Award for Excellence over all domestic competition.
David will focus on complex civil litigation, particularly for financial institution clients and on matters involving securities and complex financial products. David also will work with the firm's global white-collar and investigations team on SEC Enforcement, consumer protection and other regulatory matters, as well as on internal corporate investigations and the defense of federal and state investigations involving financial institution clients.
The appointment comes six months after Freshfields launched its US litigation practice to advise US and global clients in connection with white collar and regulatory enforcement matters, corporate internal investigations and civil litigation. The US litigation team now consists of eight partners and 21 associates, based in New York and Washington.
Commenting on the appointment, Chris Pugh, partner and head of the firm’s global dispute resolution practice, said, ‘David is an exceptionally well regarded litigator in the US and has been involved in several key class actions involving more than $1 billion over the past five years. His combination of private practice and in house experience will be a valuable addition to the quality and breadth of our litigation practice in the US. I look forward to working with David in building our litigation capabilities.’
David noted, ‘Freshfields is a well-established authority in corporate litigation and investigations, and I welcome the opportunity to further strengthen the firm’s litigation practice in the United States. The economic downturn, marked by virtually unprecedented market disruptions and aggressive governmental responses, already has complicated the litigation and regulatory challenges facing financial institutions around the world. Our clients face complex and multi-jurisdictional problems,,and Freshfields’ sophisticated, international approach is particularly valuable in an environment where corporate compliance is governed by multiple obligations in an increasingly global regulatory environment.’

Profile: David J. Onorato
Over the past five years, David played a key role in developing strategies for many of Bank of America's most important legal matters, leading to the reversal of a one billion dollar verdict in a consumer finance class action, and key precedents in areas such as federal pre-emption of state banking laws and the duties of investment banks under federal securities law.
David also negotiated Bank of America's industry-leading resolutions of securities class actions arising out of the collapses of Enron and WorldCom. In addition, he negotiated, on behalf of the underwriting industry defendants, the resolution of securities class actions arising out of the collapse of Adelphia.
In the federal regulatory area, David led an in-house group that handled major inquiries from banking, securities and other regulators, in particular inquiries from the SEC. In the state regulatory area, David negotiated Bank of America's resolution of numerous state attorney general claims of predatory mortgage lending arising out of the activities of the mortgage lender, Countrywide, which Bank of America acquired in 2008.
In 2008, International Law Office and the Association of Corporate Counsel awarded David the Global Director of Litigation of the Year award.
Before joining Bank of America, David was a partner in another major law firm where he focused on financial services matters, including successfully representing underwriting syndicates in securities class actions. In one class action, a federal appellate court affirmed dismissal under the Private Securities Litigation Reform Act in a decision that the American Bar Association recognized as among the ten most significant securities law developments of 2001.
