Schering-Corporation vs Sandoz A/S. The action concerned the scope of protection re-lating to an analogous process patent claim for the medicinal substance loratadin. The main questions at stake were a) what point in time should be considered decisive for as-sessing equivalence (i) the priority date of the patent in suit? or (ii) the time of the al-leged infringement? And b) what significance should be attached to the fact that the al-legedly infringing process was protected by its own patent? Partner(s) involved: Nicolai Lindgreen Kromann Reumert has assisted Denmark's leading energy supplier DONG Energy in connection with the sale of its fibre communications network to Danish telecom gi-ant TDC. After more than a year of preparations, an agreement was signed following an intensive sales process with several interested bidders. The purchase price was agreed at EUR 57 million, of which EUR 43 million will be paid in cash on closing, while the bal-ance will depend on the future earnings of the fibre network business in the retail mar-ket. Implemented on 2 November 2009, the issue was fully subscribed, generating gross proceeds to the company of approximately EUR 25.3 mil-lion.
