International law firm Freshfields Bruckhaus Deringer has elected three new litigation partners to expand the firm’s growing presence in the United States (US). Marshall H. Fishman, Timothy J. Coleman and Walter B. Stuart are joining Freshfields’ US litigation practice, enhancing a practice that already features the top-ranked international arbitration team in the US and several nationally prominent white-collar defense and complex litigation lawyers. This multi-faceted litigation practice mirrors the firm’s global litigation and dispute resolution practice which operates across Europe, the Middle East and Asia. Freshfields’ chief executive Ted Burke commented, ‘Our US litigation practice has become a vital part of our global offering. Our capacity to handle international arbitrations, regulatory investigations and complex litigation in the world’s major markets is unmatched and the addition of Marshall, Walter and Tim brings three more senior lawyers of exceptional experience and quality to our global practice.’ Freshfields’ US litigation practice has been anchored for a number of years by a market leading team of international arbitration lawyers who were joined last year by four litigation partners. The three new partners will contribute greatly to the firm’s US-based litigation and disputes expertise. Marshall Fishman represents major financial institutions and other entities in securities, banking and general commercial litigation. He joins the firm’s New York office to provide additional leadership to Freshfields’ US financial institutions and complex litigation practice. Marshall has decades of experience representing the world’s leading financial institutions in matters involving complex financial products and significant securities law issues. Walter Stuart is an established and distinguished trial lawyer, having won jury verdicts in multi-million dollar cases on behalf of banks, investment funds and other financial institutions. Walter has deep experience in securities and complex financial litigation at both the state and federal level, and will be resident in the firm’s New York office. Tim Coleman served with distinction for several years as an Assistant United States Attorney in the Southern District of New York and in the Department of Justice in Washington. Among the prominent cases he prosecuted in New York were the Adelphia and Datek cases and, while at Main Justice in Washington, Tim oversaw the Enron prosecutions and led the President's Corporate Fraud Task Force. Tim will work principally in the firm’s Washington, D.C. office. Fishman Marshall is formerly a partner and commercial litigator at Kramer Levin Naftalis & Frankel LLP with substantial expertise in securities, broker-dealer, banking and general commercial litigation. He represents financial institutions in federal and state courts throughout the US, in arbitrations and in regulatory proceedings. Marshall has represented some of the world’s largest financial institutions, major corporations and individuals in lawsuits in federal and state courts. His representations have involved 10b-5, RICO, derivatives, swaps, repos, mortgage backed securities, CDOs, commodity futures, proxy contests, tender offers, fraud and breach of contract. Notably, he represents institutions in cases arising out of the collapse of hedge funds that lost value due to the credit crisis and his experience includes the successful representation of a financial services firm in multiple suits aggregating $100 million in potential exposure brought by off-shore investors claiming fraud and market manipulation. Marshall was selected by Best Lawyers in America as one of the leading commercial litigators in the United States. He is also listed in New York Super Lawyers and Who’s Who in American Law. Marshall was educated at Georgetown University Law Center where he was a Law Review executive editor and graduated Phi Beta Kappa and magna cum laude from Syracuse University. Timothy J. Coleman Tim joins Freshfields from law firm Dewey & LeBoeuf where he was a partner in the firm’s Litigation Department and co-chair of the White Collar Criminal Defense and Investigations Practice Group. In private practice, Tim has represented corporations and individuals in criminal and regulatory investigations, and in related civil proceedings. He has also represented clients in matters involving securities fraud, antitrust violations, commodities fraud, health care fraud, official corruption and other substantive areas of the law. Tim served for more than eight years with the US Department of Justice, where he played a leading role in some of the most notable corporate fraud cases of recent times. As a senior advisor to the Department's leadership, he supervised the work of federal prosecutors throughout the United States on major corporate investigations, including the investigation of Enron Corporation. Tim was responsible for the President's Corporate Fraud Task Force, served as the Justice Department's Special Counsel for Healthcare Fraud and chaired the Attorney General's Working Group on Sentencing Policy. As an Assistant United States Attorney for the Southern District of New York for more than six years he was the lead prosecutor on numerous major corporate investigations, including the investigations of Adelphia Communications, Vivendi Universal and Datek Securities. Tim is a 1990 graduate of the Georgetown University Law Center where he was a member of the Georgetown Law Journal. Walter B. Stuart Walter, formerly a partner at Vinson & Elkins LLP (Houston, Texas), is an active and accomplished practitioner in securities and complex financial litigation in the United States. His trial, advocacy and negotiating skills have benefited companies and individuals engaged in the financial, energy, technology, insurance and telecommunications industries, in matters involving securities, antitrust, bankruptcy, contract, accounting, insolvency, and intellectual property issues. Walter has represented over 100 officers and directors of publicly traded corporations in derivative action and shareholder litigation throughout the United States. He has also represented corporate clients throughout the United States as lead or national coordinating counsel in federal and state class action litigation, including securities litigation. Walter has appeared in The Best Lawyers in America in business litigation, commercial litigation, corporate law and banking law. He has a B.A. from Tulane University and was educated at Tulane Law School graduating with honours, also holding the position of editor-in-chief of the Tulane Law Review.
